JUDGEMENT

(1.) This will be read in continuation of my order of date in CO No. 2 of 1991. After hearing the parties and their counsel, the permanent alimony for the wife, maintenance for the daughters and apportionment of the joint property belonging to them is made as under :-

(2.) The husband is an Accountant in Punjab and Sind Bank and is drawing Rs. 3800/- per month. Keeping in view the present income of the husband, I fix the monthly maintenance allowance for Smt. Hardev Kaur at the rate of Rs. 500/- payable from the date of this order. From this wedlock two daughters namely, Gurjit Kaur and Inderpreet Kaur were born who are alive and are aged 10 years and 7 years respectively. Both these girls are receiving education at Government Girls High School, Anandpur Sahib. Maintenance allowance for each girl is assessed at Rs. 200/- per month. The maintenance allowance will be paid to them till their marriages. In the eventuality of death of either of them or both of them before marriage, it will cease from the date of death. The husband has already deposited a sum of Rs. 16,000/- in fixed deposit with Punjab and Sind Bank, Anandpur Sahib. He will deposit an additional sum of Rs. 14,000/- within two months from today. These amounts will be deposited by him in the names of minor daughters through him.

(3.) This course has been adopted since I am told at the bar that he being a bank employee is entitled to higher rate of interest. The bank will not disburse this amount to him nor allow him to raise any loan against it. Fifty per cent of the accrued amount covered under these fixed deposits will be paid to Gurjit Kaur at the time of her marriage and the remaining amount would be paid to Inderpreet Kaur at the time of her marriage. The Guardian Judge/Senior Sub-Judge, Ropar will release the amount on satisfaction that the marriage has been fixed and will ensure payments to the minor girls. The husband at present is in employment. On his superannuation, his salary is likely to decrease. This Court will review the question of payment of maintenance to Smt. Hardev Kaur, if she remains alive and unmarried at that time. In addition to the amount already mentioned, the husband will pay Rs. 5000/- to each daughter at the time of their marriage and if he fails to pay it, the amount will be deducted out of his provident fund and paid to the girls. He has four gold bangles and a gold ring in his possession. He will return the same to the wife (Hardev Kaur) in the presence of the Registrar of this Court on 15.2.1991 at 11 AM against receipt. Some other articles like sofa set, utensils etc. have to be returned to the wife but since these are not worthwhile and in returnable condition, I assess the value of the same at Rs. 2000/- which the husband will pay to the wife on 15.2.1991.
