JUDGEMENT

(1.) In this writ petition, the petitioner is seeking direction to the respondent-University to permit him to take examination of B.Ed. Course for the Session 1989-90.

(2.) The case of the petitioner is that he was admitted to B.Ed Course after having been found duly eligible. Despite that, the University has not allowed him to appear in the examination on the ground that he had made false statement in column No. 10(c) of the admission form for B.Ed. course by stating that he had qualified English as one of the subjects in B.A. Part-I whereas he never qualified the same. The petitioner had failed to produce any certificate to show that he had qualified English as one of the Subjects in B.A. Part-I. The petitioner has impugned the action of the University on the ground that he was admitted to the B.Ed. Course after thorough scrutiny of the admission form and he was being found eligible.

It is also contended that there was no concealment or mis-statement of facts by the petitioner as he had not mentioned in the admission form that he had passed English as one of the subjects in B.A. Part-I. The other plea of the petitioners counsel is that once the petitioner is given admission, rightly or wrongly, the respondent-University is estopped from preventing the petitioner to appear in the B.Ed. examination. It has also been brought to the notice of the Court that from the current academic session the condition of passing of English as one of the subjects in B.A. Part-I is not essential for admission to B.Ed. Course.
