JUDGEMENT

(1.) Sulekh Chand Sharma petitioner sought regularisation of his services and submitted representation to the respondents on May 21, 1990. On that very day he filed CWP No. 7477 of 1990 in the High Court on which order was passed on May 22, 1990, directing the respondents to dispose of the representation within six months and in the meantime status quo regarding the services of the petitioner to continue. Since the petitioner was not allowed to join duty thereafter in spite of notices sent, he filed the present contempt petition.

In the separate replies filed by the respondents the stand taken up is that the representation was received after the order of the High Court and a notice terminating services of the petitioner was passed on May 19, 1990. Since the petitioner refused to accept the same, he absented. One month's notice was given for terminating his services. He had joined on July 31, 1989. It is further stated that representation was also decided and rejected on June 15, 1990. Thus the services of the petitioner stood terminated with effect from June 19, 1990. Cheques for the arrears of pay etc. were sent to the petitioner by registered post which were returned.

(3.) Since life of interim order was upto the date of decision of the representation, no contempt was made by the respondents in terminating the services of the petitioner. Even if there was some delay in communicating the order of the High Court it will have no effect. The representation stood disposed of within the period provided in the order of the High Court. It is left to the petitioner to seek relief if any, against the orders of terminating his services in the appropriate Court. It is not necessary to enter into any disputed question as to when the order of the High Court was communicated to the respondent. Dismissed. No costs.
