(1.) This revision petition has been filed by Manmohan Lal landlord against the judgment of the appellate Court, Sangrur dated 21-5-1979.
(2.) Briefly the facts are that the landlord filed an application for ejectment against his tenant Jora Singh on the ground of non-payment of rent and personal necessity. The tenant contested the application and denied that the landlord required the premises for his own occupation and further pleaded that he was in possession of a big house. He, however, tendered the arrears of rent on the first date of hearing. In view of the tender of the rent, the ground for ejectment of the tenant on the basis of non-payment of rent was given up by the landlord.
(3.) The learned Rent Controller held that the landlord required the premises for his own use and occupation and consequently, he ordered the ejectment of the tenant. The latter went up in appeal before the appellate authority, who accepted the same and held that the landlord did not require the premises for his own use and occupation. Consequently he accepted the appeal, set aside the judgment of the Rent Controller and dismissed his application. The landlord has come up in revision against the order of the appellate authority to this Court.
