JUDGEMENT

(1.) The petitioner was appointed as Clerk-cum-Typist in the District Board, Karnal, in 1959 and he worked there up to February 20, 1964, on different posts. On the abolition of the District Boards, his services were allotted to Panchayat Samiti, Shahabad, tahsil Thanesar, District Karnal, where he has been working eversince. Three posts of Head Clerks were to be filled in and the District Committee advertised these posts in the "Tribune" of April 19, 1966. The petitioner was one of the applicants. The written statement shows that 22 candidates were called for interview including the petitioner and respondents 3 to 5. Out of them respondents 3 to 5 were selected on the basis of the marks obtained by them in the interview. The petitioner has filed the present petition challenging their appointments.

(2.) Written statement has been filed by Gurinder Singh, Ex-Chairman, District Committee, and Avtar Singh Kahlon District Development and Panchayat Officer, Karnal. This return is not in the proper form according to the rules of this Court, but I have taken it into consideration.

(3.) It is evident that the District Committee did not pay any attention to the Punjab Panchayat Samitis and Zila Parishads Rules, 1965, before advertising the posts of Head Clerk in the "Tribune". Rule 8 of the said Rules prescribes the method of recruitment and qualification and reads as under :
