JUDGEMENT

(1.) Heard through video conferencing.

(2.) The petitioner is seeking regular bail in FIR No.190 dated 08.07.2020, under Sections 370, 420, 406, 506 IPC and Section 24 of the Immigration Act, registered at Police Station Ram Nagar, District Karnal.

(3.) Learned counsel for the petitioner contends that it is alleged that the petitioner had taken 20 lakh in cash from the complainant for sending son of the complainant to America. He, however, contends that there is a delay in filing the FIR as the son of the complainant had allegedly gone abroad in the year 2018 and he was deported from America on 03.07.2019 while the FIR was lodged on 08.07.2020.The source of the money which was allegedly paid in cash by the complainant to the petitioner is also not forthcoming. He also contends that the petitioner is suffering from Nodule growth on his larynx and he has been advised Laryngoscopy. He is on steroidal medicine and further treatment is held up due to Covid-19 pandemic. He referred to a copy of the order of the Additional Sessions Judge, Karnal dated 02.04.2021 wherein it is mentioned that the petitioner had been referred to Civil hospital and Kalpana Chawla Medical College & Hospital, Karnal for treatment on several occasions. He has also furnished copies of the records of the petitioner's treatment at PGIMS Rohtak which are taken on record. He is in custody for over 8 months. No recovery has been effected from the petitioner after his arrest in this case. He further contends that the petitioner was also involved in another case wherein he has been granted anticipatory bail in CRM-M-20927- 2019 on 16.07.2019.
