BHURI Vs. STATE OF HARYANA

JUDGEMENT

(1.) This petition under Sec. 439 Cr.P.C. is filed seeking regular bail in case FIR No. 409, dtd. 11/10/2020, under Ss. 3 and 13(3) of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015, registered at Police Station Punhana, District Nuh.

(2.) The police party received a secret information on 11/10/2020 that Salim, Moosa and Bhuri@ Akthar are indulged in business of cow slaughtering. On that date they were slaughtering the cow in the house of Moosa. A raid was conducted, the accused fled away from the spot. Hundred kilograms of beaf, two big knives and weighing scale were recovered.

(3.) Learned counsel for the petitioner submits that petitioner is in custody since 24/7/2021, investigation is complete, petitioner was not apprehended from the spot and no recovery was made from him.
