JUDGEMENT

(1.) Application is allowed subject to all just exceptions.

(2.) The present petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 24.2.2011 (Annexure P5) passed by learned Civil Judge (Junior Division), Jalandhar dismissing application of Petitioner-Plaintiff filed under Section 151 of Code of Civil Procedure for leading necessary evidence as prayed for in the application, in rebuttal.

(3.) I have heard learned Counsel for the parties and have gone through the whole record carefully including the impugned order passed by learned trial Court.
