RANJEET SINGH Vs. UNION OF INDIA AND OTHERS

Decided On January 14, 2011
RANJEET SINGH Appellant
V/S
UNION OF INDIA AND OTHERS Respondents

JUDGEMENT

(1.) This is an application seeking review of order dated 12.07.2010 passed by this Bench. In order to support the review application, the applicant-petitioner has placed reliance on additional documents which were neither before the Chandigarh Bench of Central Administrative Tribunal (for brevity 'the Tribunal') nor such documents were brought to the notice of this Bench when writ petition was dismissed upholding the order of the Tribunal dated 14.01.2010 (Annexure P-13).

(2.) The applicant-petitioner has claimed that the qualifications which were advertised in the advertisement dated 29.11.2003 (Annexure P-3) are completely answered by the various documents, which have now been placed on record. The remedy of seeking review could apparently lie before the Tribunal and especially when the documents which are not being relied, were not appreciated by the Tribunal as they were never produced before it. Therefore, we dispose of the review application by directing the applicant-petitioner to avail appropriate remedy before the Tribunal and we also clarify that dismissal of the writ petition vide order dated 12.07.2010 would not stand in his way, if the Tribunal comes to the conclusion that certificate now produced could answer the description of the qualifications advertised for the post of Fireman. Review application stands disposed of.
