JUDGEMENT

(1.) CHALLENGE is to the judgment dated September 22nd, 2010 passed by Additional Sessions Judge, Kapurthala, affirming the judgment of conviction dated January 29th, 2010 of Special Judicial Magistrate, Kapurthala, whereby, petitioner was convicted for the offence punishable under Section 138 of Negotiable Instrument Act (for short 'N.I. Act') and sentenced to undergo rigorous imprisonment for a period of one year and to pay fine of Rs.5000/ -with default stipulation. However, the sentence of imprisonment was reduced to nine months.

(2.) HE was allowed interim bail by Ajay Tiwari, J. vide order dated March 01st, 2011, which is reproduced as under: -

(3.) CASE called twice. None has appeared on behalf of the petitioner. On the last date also, neither the petitioner was present nor he was represented through counsel. In view of this, bail granted to the petitioner is cancelled.
