JUDGEMENT

(1.) This is an application seeking anticipatory bail in case F.I.R. No. 115 dated 22.12.2010, under Sections 420, 120-B I.P.C., registered at Police Station Mataur, S.A.S. Nagar, Mohali.

(2.) Perusal of the record reveals that the Petitioner has received Rs. 1,17,000/-from the complainant to arrange the visa by playing fraud. When visa was not arranged, the complainant sought her money back, but it Crl. Misc. No. 832 of 2011 was denied. Earlier complaint filed by the complainant was referred to the Incharge Economic Wing, who after enquiry has submitted his report and thereafter, F.I.R. in question was lodged against the Petitioner.

Learned Counsel for the Petitioner has argued that in fact, the Petitioner has not taken even a single penny, rather, complainant has entered into the agreement with the Petitioner (Annexure P/2). It is agreed by the complainant that she would pay her 50% salary for the first month after lending in USA. Prima facie it shows that the Petitioner not only induced the complainant to part with the money but also induced the complainant to enter into the agreement to part with her 50% salary after lending in USA. Allegations against the Petitioner are serious in nature, which require thorough investigation.
