HAZARA Vs. STATE OF HARYANA AND OTHERS

JUDGEMENT

(1.) Application is allowed as prayed for.

(2.) The present petition under Section 482 Cr.P.C. has been filed on behalf of petitioner-Hazara for issuing directions to respondents No.2 and 3 for conducting fair and impartial investigation of case FIR No. 252 dated 26.7.2010 registered under Sections 323/307/506/34 IPC at Police Station Hathin, District Palwal.

(3.) Learned counsel for the petitioner contends that the petitioner filed a criminal complaint against the accused persons who are witnesses in the said FIR, which is pending before the Court of Ld. JMIC, Hathin. Learned counsel further submits that there is a delay of six days in lodging the aforesaid FIR and the same has been registered on the basis of incorrect MLR. Learned counsel also relied upon the newspaper cutting annexed with the petition to support his contention.
