JUDGEMENT

(1.) NON -petitioner Kulwinder Kaur appeared as a surety under the name of Muskan Sharma and submitted surety bonds for Malkit Singh before the trial Court in private complaint under Sec tion 138 Negotiable Instruments Act. She has been granted bail by this Court on 14.11.2011. Petitioner is alleged to have helped Malkit Singh to procure fake surety to get bail to enable him to file an appeal after his conviction. The petitioner had apparently provided the fake documents to produce with surety bonds. Though the offence is very serious but in view of the fact that the petitioner has been in custody for the last 3 1/2 months and the trial is likely to take long time, petitioner can be granted concession of regular bail. Petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/ Duty Magistrate, subject to the condition that the petitioner will not commit any similar offence of which he is accused of during the pendency of trial.
