LEKH RAJ Vs. STATE OF HARYANA AND ORS

JUDGEMENT

(1.) Instant petition has been filed by the Petitioner under Section 226 of the Constitution for issuance of a Writ in the nature of Habeas Corpus for appointing a warrant officer and roving writ to search the premises at Brick Kiln Marka BBC(Bajrang Bhatta Co.) situated in the area of village Chhabeli, P.S. Sadar Jhajjar, District Jhajjar, Haryana of Respondent No. 3 and other places to be point out by the Petitioner and get released the detenues as mentioned in para No. 5 of the Petitioner along with their belongings of daily life etc.

(2.) Reply by way of affidavit has been filed by Sh. Dalip Singh, Deputy Superintendent of Police Jhajjar, District Jhajjar on behalf of Respondent No. 2 wherein it is stated that pursuant to the directions issued vide orders dated 07.03.2011 passed by this Court a committee consisting of Tehsildar Jhajjar, Labour Officer Bahadurgarh, Inspector Food and Supply, Jhajjar along with police official was constituted by the District Magistrate Jhajjar for inspecting the site and to report whether there is any detenues/bounded labour at M/s BBC Bhatta Co. Chhabeli, District Jhajjar. Said Committe inspected the aforesaid site and met the workers/labourer who apprised them that they have never been detained/bonded in any manner on the brick kiln in question and they are/were free to come and go anywhere as per their wishes and were also provided with all the facilities/basic amenities and wages fixed by the Government and at that time they were leaving the brick kiln with their sweet will/wishes.

(3.) None has appeared to controvert the contents of the reply or the report of the committee.
