(1.) The petitioner seeks for protection of his life and liberty from the 4th respondent, who the petitioner claims had physically assaulted him and the petitioner was sent for treatment only at the intervention of a Judicial Magistrate before whom he was produced. It appears that the petitioner has filed a complaint for offences under Section 323 and 325 IPC and the case has also been registered before the JMIC, Gurgaon. The contention of the petitioner is that the 4th respondent is threatening the petitioner that he would cause further harm unless he withdraws the complaint lodged against him.

At the first hearing, I directed the State counsel to take notice and also secure instructions on the nature of action taken against the 4th respondent in view of the prima facie material available that the petitioner has suffered serious physical harm and the actual fact of a complaint having been registered and a case is pending before the JMIC, Gurgaon against the 4th respondent. The reply has been filed denying in general terms the petitioner's allegation that the 4th respondent is causing any harassment. I am convinced prima facie that the 4th respondent's actions have caused reasonable apprehension to the petitioner and I would direct the respondents 2 and 3 to afford sufficient protection to the petitioner against any form of harassment by the 4th respondent. The counsel for the State says that the 4th respondent has been transferred from his station house to the office at Bilaspur. The counsel also states that the petitioner shall be at liberty to approach respondents 2 and 3 at any time if ever he faces any form of harassment by the 4th respondent or anyone acting at his behest. I take the statement of the counsel as an undertaking made on behalf of the State. I do not think that any further directions are necessary
(3.) The petition is disposed of with the directions for protection to the petitioner as referred to above.
