JUDGEMENT

(1.) This petition is directed against the order dated 25.01.2007, passed by the Civil Judge (Junior Division), Batala, dismissing the application of the petitioner for setting aside the ex-parte proceedings as well as the order dated 15.10.2009, passed by the Addl.Distt. Judge, Adhoc, Fast Track Court, Gurdaspur, dismissing his appeal against the aforesaid order.

(2.) It has been informed that the suit has been decreed ex-parte, as such, the present petition is not maintainable.

(3.) Faced with the situation, learned counsel for the petitioner prays for withdrawal of the present petition with liberty to file the appeal if so desired.
