GURDIAL SINGH Vs. STATE OF PUNJAB & ANR.

JUDGEMENT

(1.) THIS petition has been filed under Section 482, Code of Criminal Procedure, praying for quashing of FIR No.165 dated 23.7.2011 under Section 420, Indian Penal Code, Police Station, Nakodar, District Jalandhar (Annexure P -1) and subsequent proceedings, on the basis of compromise dated 9.8.2011 (Annexure P -2).

(2.) LEARNED counsel for the petitioner and respondent No.2 contend that the FIR came to be lodged on account of money dispute; the dispute has, now, been settled and the claim of respondent No.2 has been satisfied.

(3.) LEARNED counsel for the respondent -State contends that because the disputes have been settled by way of compromise, the State would have no objection to the quashing of the FIR.
