KAPIL Vs. STATE OF HARYANA

JUDGEMENT

(1.) THIS order of mine shall dispose of two revision petitions bearing CRR No. 2598 of 2010 titled "Kapil v. State of Haryana" and CRR No. 3371 of 2010 titled "Manoj Kumar v. State of Haryana", as they arise out of the same order dated 25.8.2010 passed by learned Additional Sessions Judge, Narnaul, vide which the application under Section 319 Code of Criminal Procedure filed by the prosecution was allowed and revisionists Kapil and Manoj Kumar were ordered to be summoned to face trial under Sections 323, 307, 506 read with Section 34 of the Indian Penal Code.

(2.) FOR brevity sake facts are being taken from CRR No. 2598 of 2010.

(3.) AFTER completion of the investigation, challan was presented against Balwan Singh and Muni Devi. The accused were chargesheeted to which they pleaded not guilty and claimed trial. Thereafter, the prosecution was called upon to adduce its evidence.
