PETITIONER - Manjit Singh has applied for grant of anticipatory bail in FIR No. 9 dated 6.2.2011 under Sections 341, 323, 148, 149, 506, 427, 325 IPC (later on offences under Sections 336, 382 IPC and 25/54/59 Arms Act, added and later on again offence under Section 308 IPC added), registered at Police station Dorangala, District Gurdaspur.
(2.) AS per allegation of the prosecution, Petitioner gave iron rod blow on the left knee of the complainant -Amrik Singh which injury was declared grievous. Amrik Singh also suffered other grievous injures which are on the left side of the lower leg and on the wrist joint. Initially the case was registered under Sections 341, 323, 148, 149, 506, 427, 325 IPC. On 22.2.2011, offence under Section 308 IPC was added. The doctor has opined that possibility of these injuries collectively could be dangerous to life cannot be ruled out. The opinion is not categorical. The Petitioner has joined the investigation and weapon of offence is stated to have been recovered from him. So, in these circumstances, the application for grant of bail stands accepted and the in the event of arrest the Petitioner is ordered to be released on bail to the satisfaction of SHO/Investigating Officer, on the following conditions:
(3.) LEARNED State counsel has submitted that vide order dated 30.3.2011 passed in Crl.M. No. M -5594 of 2011, this Court ordered the investigation of the case through an IPS Officer of integrity. Learned State counsel, on instructions from ASI Avtar Singh, has further submitted that in whole of the District, no IPS Officer has been posted.
