JUDGEMENT

(1.) THE counsel pleads that the respondent could not prove herself to be the legally wedded wife of the petitioner. Even it be so, that is not sufficient to deny maintenance in the background of factual position in the case.

(2.) THIS is a case where the petitioner has played fraud with the respondent, who is widow. The petitioner is a Police Constable and has played fraud with respondent to get married to her. The petitioner posed himself to be a widower and, thus, got married to the respondent. The fact that the petitioner has a living wife revealed to the respondent late. Enquiry has already been held, which has found the petitioner guilty of the said allegation, leading to punishment.
