GURMUKH SINGH Vs. STATE OF PUNJAB

JUDGEMENT

(1.) CUSTODY certificate handed over in Court today is taken on record.

(2.) PETITIONER was found guilty under Sections 304 -A/337 of the Indian Penal Code by the learned Trial Court and was sentenced to undergo rigorous imprisonment for a period of one year and to pay a fine of Rs. 300/ - under Section 304 -A IPC and in default of payment of fine to undergo simple imprisonment for five days. He was further sentenced to undergo rigorous imprisonment for a period of three months and to pay a fine of Rs. 200/ - under Section 337 IPC and in default of payment of fine to undergo further simple imprisonment for five days. All the sentences were ordered to run concurrently. In appeal preferred by the accused/Petitioner, learned Appellate Court/Additional Sessions Judge (Ad hoc) Fast Track Court, Gurdaspur, vide judgment dated 8.12.2010, affirmed the sentence awarded by the learned Trial Court and appeal filed by the accused/Petitioner herein was dismissed.

(3.) MS . Bhavna Gupta, DAG, Punjab, states that Petitioner/revisionist is the first time offender and no other criminal case is pending against him. She further submits that the accused/Petitioner has undergone sentence for a period of about one month and thirteen days.
