JUDGEMENT

(1.) THIS is a petition under Section 438 Cr.P.C. seeking pre arrest bail in a criminal complaint bearing No.5496/2/2009 dated 9th December, 2009, under Section 138 of Negotiable Instruments Act, pending in the court of Judicial Magistrate 1st Class, Jalandhar.

(2.) LEARNED counsel for the petitioner submits that the petitioner could not appear before the trial court during the proceedings as service was not effected on him. On 7th January, 2011, he was present in court but his presence could not be marked. Learned counsel further submits that the petitioner is ready to furnish an undertaking before the court that he will not absent from the court proceedings on any date in future and is ready to pay the cost of the proceedings.
