(2.) THE Petitioner, Diwan Chand, has filed this petition under Section 439(1) of the Code of Criminal Procedure for the grant of regular bail in FIR No. 106 dated 28.8.2008 registered under Sections 302, 323, 324/148 and 149 IPC. This petition has been pressed on the ground that similarly situated accused; namely Banarsi Dass and Salamat Masih have already been allowed the benefit of regular bail by this Court, vide orders dated 12.1.2010 and that the present Petitioner cannot be discriminated against.

(3.) IN order to maintain judicial uniformity and to prevent any type of discrimination, the Petitioner is ordered to be released on bail to the satisfaction of the trial court/Chief Judicial Magistrate, Amritsar, subject to the following conditions:
