JUDGEMENT

(1.) SMT . Nirdeep Kaur, the applicant wife has preferred the instant application under Section 24 of the Code of Civil Procedure, praying for transfer of the petition titled as 'Balkar Singh v. Nirdeep Kaur', filed by the Respondent under Section 9 of the Hindu Marriage Act, 1955 (for short 'the Act'), from the Court of learned Additional Civil Judge (Sr. Divn.), Hoshiarpur, to the Court of competent jurisdiction at Jalandhar.

(2.) LEARNED Counsel for the applicant contends that the applicant filed petition under Section 125 Cr.P.C., which is pending adjudication before the Court of learned JMIC, Jalandhar, and as a counter -blast, the Respondent has filed the petition under Section 9 of the Act.

(3.) LEARNED Counsel for the Respondent has vehemently opposed the prayer.
