(1.) The petitioner has failed in 8th class examination conducted by Board of School Education, Haryana Bhiwani. Thereafter he obtained a transfer certificate on 11.8.1987 and passed matriculation from Varanasi Sanskrit Vishywabidyalaya, stated to be in Utter Pradesh. Thereafter the petitioner obtained a Conductor's licence on the basis of alleged matriculation qualification. The petitioner got his name registered with the Employment Exchange. He was appointed as a Driver during the period of strike being matric pass. The petitioner claims that being fully satisfied, he was given this appointment by General Manager, Haryana Roadways, Kurukshetra. The petitioner was regularised also. Further claims that there was no complaint against the efficiency, work, conduct and punctuality of the petitioner, but all of a sudden he received a memo on 25.10.2004 containing summary of allegations to the effect that the school leaving certificate showing 8th class pass deposited by the petitioner was found to be false on verification being done from the Headmaster of the Government Middle School, Sehri (Sonepat). The petitioner submitted his reply denying this fact that he had submitted this certificate showing him to be 8th pass. As per the petitioner, there were many occasions to check the authenticity of the certificate and now acting against him on this ground would be unreasonable.
(2.) The petitioner has been dismissed from service on 30.3.2005. His appeal was rejected on 28.8.2006. The petitioner then served a legal notice, which was followed by a representation. He has accordingly now filed this writ petition to impugn his dismissal.
(3.) When the case came up for hearing before the court on 1.4.2011, the petitioner was given liberty to place on record the reply given by him to the show cause notice to ascertain the stand taken by the petitioner in response thereto. The petitioner has not placed on record the reply despite opportunity given to him. Counsel prays for further time to place on record the reply.
