JUDGEMENT

(1.) THE Petitioner has challenged the selection of the private Respondents primarily on the ground that they do not hold the qualification prescribed for the post advertised, which is diploma in Mental Retardation (DMR) or DVTE (MR) or MBR coupled with matric with Hindi.

(2.) IN response to the notice, private Respondents have filed the reply. Mr. Malik points out to the qualification possessed by the Respondents to say that they are possessing higher qualification in the same line. Mr. Malik would also refer to Annexures R -4/1 and R -4/2 on the basis of which similar challenge to the same selection did not succeed before this Court in CWP No. 18956 of 2008, decided on September 4, 2009 as the counsel appearing therein had withdrawn the writ petition being infructuous.
