KABAL SINGH AND ANOTHER Vs. STATE OF PUNJAB

JUDGEMENT

(1.) Kabal Singh s/o Raghbir Singh and Bhagwan Singh s/o Mohan Singh has applied for grant of anticipatory bail in FIR No.35 dated 29.7.2010 under Sections 326, 325, 323, 148, 149 IPC, registered at Police Station Chatiwind, Amritsar Rural. As per allegation of the prosecution, Bhagwan Singh gave injury with stick on the left arm of Davinder Singh-complainant, which was declared grievous. Whereas, Kabal Singh gave blow with baseball which struck on the back of the left shoulder of the complainant. Both of them have taken active part in the occurrence. Injury attributed to Manjit Singh is on the head.

(2.) Mere fact that it is cross version and that Bhagwan Singh has also received injury, does not make out a case for concession of anticipatory bail.
