JUDGEMENT

(1.) THIS is a petition seeking interim bail in case FIR No. 131 dated 05.09.2007, under Sections 304 -B, 120 -B of the Indian Penal Code, registered at Police Station Dasuya, District Hoshiarpur.

(2.) PETITIONER 's first bail application was dismissed on 01.04.2009; second bail application was dismissed on 26.11.2009 and third was also dismissed on 24.09.2010. Now, Petitioner is seeking interim bail stating that Petitioner's mother had died on 06.04.2011 and her kirya is fixed for 01.06.2011, therefore, he may be enlarged on interim bail to attend the kirya of his mother.

(3.) ON being asked as to whether Petitioner has other brothers, learned Counsel for the Petitioner states yes. In the opinion of this Court, since deceased Darshna Devi was having other sons also, therefore, kirya would not have been postponed as suggested by the learned Counsel for the Petitioner. It seems to be a cooked up a story to obtain bail from this Court.
