(1.) THERE is no representation for the petitioners. Counsel for the respondents is present and ready. I proceed to dispose of the case with the records available and with the assistance of the counsel for the respondents. The petitioners seek for a higher scale of pay and consequential benefits on the basis that they are all JBT teachers and by virtue of the circular issued on 23.07.1957 and letter dated 07.08.1985, the claimants would require to be paid higher scales. The contention in defence by the State is that the grades of JBT teachers and persons teaching vernacular languages are always varied and they were revised from time to time. The services of JBT teachers were never treated on par with Classical & Vernacular (C&V) teachers and the respective cadres also varied. The State, therefore, stated that JBT teachers had no right to claim higher grades similar to those in the grade of C&V teachers on account of their higher qualifications. I have not the benefit of the counsel for the petitioners to make out a case as to how the government circular issued on 23.07.1957 would apply to them and how without improvement in their qualifications, they could have been covered under the government circular issued on 23.07.1957. It is further pointed out in the reply that the petitioners fell in Group 1 and not in Group II of Category B of the government circular and there had never been any direction for improvement in the scale on par with C&V teachers. The petition is dismissed.
