SUKHWINDER SINGH Vs. STATE OF PUNJAB

JUDGEMENT

(1.) Sukhwinder Singh s/o Jit Singh has applied for grant of regular bail in FIR No. 164 dated 17.12.2010 under Sections 406, 420 IPC registered at Police Station Kotwali Nabha, District Patiala. As per allegation of the prosecution, 5 students were to be admitted in ETT and ' 1 lac per student was charged by the petitioner. It is further alleged that only ' 4,500/- per student has been deposited with the University. The remaining amount has been misappropriated by the petitioner.

(2.) Learned counsel for the petitioner has submitted that normally the admission is done by taking donation, for which no receipt is issued. He has further contended that FIR has been registered only after completion of the course.

(3.) The case is triable by the Magistrate.
