PIARA SINGH Vs. STATE OF HARYANA

JUDGEMENT

(1.) PIARA Singh was appointed as Secretary -cum -Manager in the clerical cadre on July 23, 1976 under the Haryana State Central Co -operative Bank (Common Cadre Rule 1975). On the completion of his probation period he was conformed and transferred to Khotpura Credit Service Society.

(2.) ON February 17, 1982 a criminal case under Section 409 I.P.C. was registered against him in the Police station Gharaunda. Department inquiry was also initiated against him. The Enquiry Officer had conducted the enquiry against the principles of natural justice as neither evidence was recorded in his presence nor any opportunity of hearing was given. Resultantly, his services were terminated on 21.8.1984. The order terminating his services of which the legality has been challenged, a reference under Section 10 Clause (1) sub -clause (c) of the Industrial Disputes Act, 1947 (short the Act) was made by the State of Haryana for the adjudication of the dispute.
