JUDGEMENT

(1.) THE petitioner was not apprehended at the spot. As per the allegations of the prosecution, the house of the petitioner was raided. On seeing the police party, the petitioner ran away from the spot. From the search of the house, 25 kg poppy husk was recovered. As per the requirement of Section 100(4) Cr.P.C., two independent witnesses from the locality had not been joined. Shri R.P.S. Athwal, on the instructions of Kishan Singh HC stated, that the independent witness was joined from village Bhedpur. The petitioner is in custody since 4.1.2001. It will take long time in concluding the trial.

(2.) WITHOUT commenting any further on the merits of the case. Petitioner be admitted to bail to the satisfaction of CJM, Patiala.
