JUDGEMENT

(1.) The Ajnala Co-operative Sugar Mills Ltd. - respondent No. 3 advertised in the newspaper on 12.10.1990, (Annexure P1), for filling various posts like fitter helper, electrical helper, Blacksmith, machinist helper etc. In pursuance of the advertisement the petitioner also applied for the post of machinist helper. Interviews were held and the petitioner was selected as a machinist helper vide letter dated 31.12.1990, annexure P2. In the said letter, it was mentioned that "the grade etc. will be mentioned in the appointment letter which will be issued to you after joining the duty."

(2.) Instead of issuing the appointment letter the petitioner was being paid fixed salary of Rs. 1200/- per month from the date of his initial appointment till the date of his regularisation i.e. upto 15.6.1996. The claim in the present petition is that the petitioner should be paid salary of machinist helper in the grade of Rs. 800-1050 from the date of his initial appointment and not from the date of regularisation which was with effect from June, 1996.
