JUDGEMENT

(1.) The prosecution story is as under:-

(2.) The prosecution, in support of its case, examined inter alia P.W.-l. Bhateri Dev, the first informant and the mother of the deceased; P.W.-2 Rohtash, the brother of the deceased; P.W.-6 Dr. (Mrs.) Urmil Dhattarwal, who had conducted the post-mortem examination on the dead body and had opined that the death had been caused due to asphyxia as a result of hanging; and P.W.-7 A.S.I. Debu Ram, the Investigating Officer, Sadhu Ram (P.W.-), who had carried the message from Hansi to Dhani Khan Bahadur was, however, given up as unnecessary.

(3.) The prosecution case was then put to the accused and their statements recorded under Section 313 of the Code of Criminal Procedure. They admitted the factum of marriage of Balbir accused with Rajal. but stated that Rajal had committed suicide by hanging as she had been suffering from acute depression. Rameshwar and Shanti accused further stated that they had never resided with Balbir accused and had been living separately. They also produced one Jagdish Chander as DW- 1 to prove this plea.
