(1.) THIS writ petition has been filed by the workman challenging the award dated July 28, 2000 and her termination order dated April 5, 1994 (copies annexures P -14 and P -7) respectively.
(2.) THE petitioner was working as a peon and she was charge -sheeted for having remained absent. In the charge -sheet, it has also been mentioned that she is a habitual absentee and remained absent on many previous occasions. The Labour Court has found no infirmity in the termination order. Enquiry was also conducted. Therefore, we do not find it proper to interfere with the finding of the Labour Court that her termination was proper. Moreover, encouraging such workers, who are habitual absentees, will give rise to an indiscipline in all sectors. That should be avoided.
