MUKAND SINGH Vs. STATE OF PUNJAB

JUDGEMENT

(1.) Heard. It is alleged that Mukand Singh petitioner caused Khappa blow on the left anm of Hans Raj near the elbow which resulted into a simple injury. It is further stated that when Jarail Singh tried to rescue Hans Raj, Ajmer Singh and Mukand Singh gave Khappa blows on his head. Learned counsel for the petitioner further contended that according to the medical report of Jarnal Singh, there is only one injury, i.e. a lacerated wound on the head of Jarnal Singh which is not possible with two Khappa blows. It is further doubtful, whether that injury has been caused by a Khappa blow.

(2.) Keeping in view the facts and circumstances of the case and without commenting whether Section 34 I.P.C. is applicable in this case or not, let the petitioner be admitted to bail to the satisfaction of C.J.M. Bathinda.
