DARA SINGH Vs. STATE OF PUNJAB

Decided On February 12, 2001
DARA SINGH Appellant
V/S
STATE OF PUNJAB Respondents

JUDGEMENT

(1.) DARA Singh, petitioner, is alleged to have been driving an unnumbered Jeep (the number was later on discovered to be RJ-19C-8640). This jeep was toeing another jeep No. DL-4CA-9670, which had apparently broke down. When the two vehicles were intercepted, the petitioner is alleged to have driven off in the jeep, which he was driving, leaving the other jeep behind. The latter jeep was found to be carrying six bags of poppy husk. The person behind the wheel of that jeep was arrested. The connection between the petitioner and the jeep, carrying the poppy husk, would be required to be established before the trial court. But at this stage, the connection depends only on the identification of one Pritam Singh. The circumstances are sufficient to entitle the petitioner to bail. Bail to the satisfaction of C.J.M. Bathinda. Petition allowed.
