JUDGEMENT

(1.) Jasbir Singh, Sarpanch, is resident of Nawan Purba, Ferozepur. At about 4 P.M. on 7.10.2000, he alongwith his younger brothers, Punjab Singh, Jagbir Singh and his mother's sister's husband Sukhchain Singh and Malik Dev Singh son of Mehal Singh resident of Nawap Purba was sitting in his house and they were talking to each other. Jarnail Singh, petitioner, former Sarpanch armed with 12 bore gun, Gurdev Singh armed with Sota, Angrej Singh armed with Sota sons of Mangal Singh, Kashmir Singh son of Sham Singh armed with 3.15 bore rifle. Gurpreet Singh son of Kashmir Singh armed with Sota came in front of the house of Jasbir Singh, Sarpanch in the street. Angrej Singh raised Lalkara that Jasbir Singh, Sarpanch should not escape alive and be killed. Upon hearing Lalkara, Jasbir Singh, Sarpanch and others came out. When they came out, then Kashmir Singh fires 315 bore rifle straight which hit Sukhchain Singh in the abdomen. Jarnail Singh, petitioner, fired 12 bore gun which hit Sukhchain Singh of the left side of the Chest and he fell down on the ground. Kashmir Singh fired another shot with 315 bore rifle which hit Sukhchain Singh on his abdomen. Jasbir Singh ran and entered his house. Malik Devi Singh, who was having 12 bore licensed gun, also fired a shot in his self defence which hit Kashmir Singh and his son Gurpreet Singh. Upon hearing Raula, many persons collected there. Jarnail Singh etc. alongwith their respective wapons ran away, Panjab Singh and Jagbir Singh witnessed the occurrence. Stkhchain Singh was taken to Civil Hospital, Ferozepur, where he succumed to his injuries.

(2.) Case was registered upon the statement of Jasbir Singh, Sarpanch. The petitioner was apprehended. Now he has applied fo regular bail.

(3.) 1 have heard counsel for the petitioner, Sh. Baldev Singh, Sr. Advocate alongwith Sh. Arshvinder Singh, Advocate, Sh. P.S. Suiller, AAG, Punjab and carefully gone through the record.
