JUDGEMENT

(1.) This Writ petition came up for hearing on Feb. 14, 1990. After hearing the parties' counsel, I allowed the writ petition, quashed the order of compulsory retirement and issued necessary direction for reinstatement and grant of consequential benefits to the petitioner. It was stated in the order that detailed reasons will follow. Now I proceed to give reasons in support of my order dated Feb. 14,1990.

(2.) The petitioner is aggrieved of his order of compulsory retirement passed against him by the Haryana Government on attaining the age of 55 years. The order of compulsory retirement, Annexure P/1 reads as follows:-

Now therefore in pursuance of the provisions contained in rule 5.32 (c) of the Punjab Civil Services Rules, Volume-II and Rule 3.26 of the Punjab Civil Services Rule, Volume-I, Part-I, as applicable to the State of Haryana the Governor of Haryana in the Public interest, hereby orders that Shri Suraj Mai Hooda, Carcass Leather Marketing Officer shall stand retired from service under the State Government of Haryana on the expiry of three months from the date of receipt of the order by him."
