JUDGEMENT

(1.) This revision petition is directed against the order of the Rent Controller, Mansa, dated June 8, 1989, whereby the application filed on behalf of the petitioner under Order 1, Rule 10, Code of Civil Procedure (hereinafter called the Code), for impleading her as a party to the ejectment application was dismissed.

(2.) Jagjit Singh, respondent, filed an application for ejectment against his tenant Kulwant Singh and Rajinder Singh. In that application, Shrimati Gurbachan Kaur, petitioner, filed an application under Order 1 Rule 10 of the Code, for impleading her as a party to the proceedings. The said application was contested on behalf of Jagjit Singh. The learned Rent Controller was found that it was not a fit case where Gurbachan Kaur could be said to be a necessary party to the petition; hence he dismissed the application.

(3.) The learned counsel for the petitioner submitted that already Civil Suit No. 692 of 14th Oct., 1988, titled as Gurbachan Kaur, plaintiff Vs. Jagjit Singh, defendant, is pending in the Court of Shri R.S. Sachdeva, Subordinate Judge, First Class, Mansa and that, therefore, it will be in the interest of justice that both the proceedings are decided together simultaneously. It was also submitted that the petitioner was a necessary party to the proceedings pending before the Rent Controller.
