JUDGEMENT

(1.) The petitioner after passing his M.B.B.S. from the Medical Colleges, Patiala in December, 1977 did his house job in Surgery and paediatric from Rajindra Hospital, Patiala from 1.1.78 to 31.12.1981. After completion of his course petitioner joined P.C.M.S. Class II on regular basis on 30.1.1979 and continued to work on the said post upto 17.1.1987. On 17.1.1987 the petitioner was selected for doing post-graduation in the department of E.N.T., Medical College, Amritsar after obtaining No Objection Certification from the Government. The petitioner was designated as Medical Officer in the E.N.T.

(2.) That on 1.10.1987, the Government issued an advertisement for the post of Registrar in the State Medical College and the petitioner was one of the appellants. This application of the petitioner was forwarded from Medical College, Amritsar as well as from Medical College, Patiala. Petitioner was selected as Registrar in General Surgery on 11.1.1988 on the basis of merit-cum-seniority. As a consequence of the order issued by the State Government dated 11.1.1988, petitioner joined as Registrar in Medical College, Amritsar on 21.1.1988. While the petitioner was working as Registrar in the Medical College, Amritsar he was selected for admission to M.D./M.S. post-graduate diploma course. This was in pursuance to the application made by the petitioner to M.D./M.S. post diploma course in 1988 session. The petitioner was selected for the post of M.S. Surgery and was placed at serial No. 3 out of the ten candidates.

Since the petitioner was doing M.S. in the E.N.T. and had now joined as Registrar in Surgery, the Principal, Medical College, Amritsar on 21.3.1988 addressed a letter to the petitioner in which it was mentioned that the petitioner was selected as Registrar in Surgery and it has come to his notice that in the application which was filled in by him, column No. 18 was left blank. Column Nos. 12 and 18 of the application are reproduced below :
