Decided On July 11, 1990
Sukhbinder Singh Appellant
V/S
STATE OF PUNJAB Respondents

JUDGEMENT

(1.) On the recommendations of the District Welfare Officer, Sangrur, the petitioner was appointed as Chowkidar-cum-Sweeper vide order dated 7.5.1985 (copy Annexure P-1) for 89 days on which post he worked upto 16.11.1988 to the best of his ability and efficiency with a notional break of one day on the expiry of each three months. But his services were terminated in an unceremonious manner on 16.11.1988. One Teja Singh Chowkidar and one Peon are stated to have been still working in petitioner's department. According to petitioner, they were appointed after his appointment. The prayer of the petitioner is that the respondents be directed to allow him to continue in service on the said post with continuity of service and other consequential benefits, in view of this Court's decision in Civil Writ Petition No. 72 of 1988 (Piara Singh v. State of Punjab) decided on 25.9.1988.

(2.) On consideration of the entire matter, I feel that this case is covered by the decision in the aforesaid case. Accordingly, the writ petition is disposed of with a direction to the respondents to consider the case of the petitioner for taking him back in service in the light of decision rendered in Piara Singh's case within four months of the receipt of this order. There is, however, no order as to costs.
