(1.) Having passed his M.B.B.S. Examination from Medical College, Amritsar in April, 1980, the petitioner joined the Punjab Medical Civil Service Class (II) for short, PCMS II) as Medical Officer on 23rd August, 1982. His services were regularised in P.C.M.S. Class II on 15th March, 1983. After putting in nearly five years' service and in order to improve his qualification, he passed his Diploma in T.B. & Chest Diseases as an in-service candidate in September, 1986.
(2.) Respondent Medical College, Patiala issued an advertisement in the Tribunal on 16th February, 1990 inviting application for admission to the M.D.M.S. courses for the session 1990-91. A copy of said advertisement in Annexure P-2 to this writ petition. Clause 6 thereof provides that candidates who have done the Post Graduate Diploma Course in one speciality will be eligible for admission to the Post Graduate Degree Course in the same speciality. As already stated, the petitioner did his Diploma in T.B. & Chest Diseases in the year 1986 and he sought admission in the M.S. in General Surgery in the year 1990 in response to an advertisement dated 16th February, 1990 (Annexure P-2). On merits he was selected for the said course and his name was accordingly placed on the list of candidates selected. Thereafter letter Annexure P-7 was written by the Principal, Medical College, Amritsar to the Principal, Govt. Medical College, Patiala, with a copy to the petitioner that the petitioner could not be given admission to the M.S. (Surgery), as he had done his diploma in T.B. & Chest Diseases, and further that he could be given admission to M.D. (T.B.) alone.
