JUDGEMENT

(1.) This revision petition is directed against the order of the Senior Subordinate Judge, Chandigarh, dated November 26, 1987, whereby Shri J.S. Kohli, the arbitrator, was removed and the Superintending Engineer, Construction Circle, Capital Project, U.T., Chandigarh, was 'appointed as an arbitrator.

(2.) The learned counsel for the petitioner submitted that inspite of the impugned order and there being no stay order, the arbitrator has not proceeded with the arbitration proceedings and under the circumstances, some independent arbitrator be appointed other than the departmental person.

(3.) I find force in this contention. The parties are directed to appear before the Senior Subordinate Judge, Chandigarh, on December 4, 1990. The learned Senior Subordinate Judge will appoint an independent person other than the Departmental person as arbitrator after consulting both the parties so that the arbitration proceedings may be finalised within the prescribed time. This revision petition is disposed of accordingly.
