(1.) Tripta Kumari alias Sarabjit Kaur the wife instituted a complaint against Darshan Singh her father-in-law and Manjit Kaur the wife of a brother of her husband, for an offence under Sec. 406 of the Indian Penal Code in respect of her ornaments and other articles of dowry. After recording the statement of complainant and other evidence Shri Joga Singh, Judicial Magistrate, 1st Class, Jalandhar, ordered the summoning of Darshan Singh and Manjit Kaur on 6-3-1987. Aggrieved against it the present revision has been attempted by Manjit Kaur.

On behalf of the revisionist Manjit Kaur who is the wife of the husband of the complainant, it has been argued that these articles were never entrusted to her and she was in fact married much later as compared to Manjit Kaur. On behalf of the respondent it has been pointed out that the contention that Manjit Kaur was married subsequent to Tripta Kumari is a belated contention and factually incorrect. It appears that the mother-in-law of Manjit Kaur was no longer alive at the time of the marriage of the revisionist. Thus, Manjit Kaur, the daughter-in-law of Darshan Singh is not entitled to any interference, at this stage and the revision is hereby dismissed. The parties shall appear in the trial Court, Jalandhar on 1-2-1990. Petition dismissed.
