JUDGEMENT

(1.) The arguments partly heard. The counsel for the petitioner prays that the petitioner should be allowed to appear in the examination provisionally subject to the decision of the writ petition. The petitioner's counsel highlighted that he has completed B. A. Part-I, and if he is not allowed to sit in the examination, all his efforts will go waste. The arguments in the main case are not going to conclude today. Mr. Subhash Ahuja, Advocate, appearing for the University submits that the University had informed the College that the admission of the petitioner had been cancelled on 29th Aug., 1989. But I have noticed that no show cause notice has been served to the petitioner before taking any such decision, nor the order of the University was served on the petitioner. In view of the hardship of the matter, in the interest of justice, I direct the respondent to permit the petitioner to appear in the B. A. Part-I examination and if he fails, he should also be allowed to appear in the supplementary examination. At this stage, petitioner counsel made a request to challenge the validity of the order which prescribed 35% minimum marks for obtaining admission to the B. A. Part-I course while pass per centage prescribed by the Education Board is 33%. He is permitted to amend the writ petition and take a ground permitted. He should file the amended writ petition within one week. Thereafter the respondents will file the amended written statement within one week. The case to come up for further arguments on 26-4-1990. Copy of this order may be given Dasti to the petitioner today. Ordered accordingly.
