JUDGEMENT

(1.) The facts leading to the controversy in this appeal are as under:-

(2.) The appellant made an application for grant of letter of administration under Section 228 of the Indian Succession Act concerning the estate of Phera Singh son of Dalip Singh since deceased. In the application it was alleged that Phera Singh died on 19th July, 1966 at Jullundur City and that he executed a will on 29th April, 1964 in favour of the Appellant who is his daughter-in-law and that at the time of the execution of the will he was in his full senses.

The application was resisted by respondents 2 and 4 and the stand taken by the contesting respondents was that Phera Singh never executed the will in favour of the petitioner-appellant and that the partition of the estate took place in the life time of Phera Singh and Plot No. 28 was given to respondent No 2 Udham Singh and plot No. 29 was given to respondent No 4 Udham Kaur and that Udham Singh thereafter constructed a house over the plot and hi, family started living in that house.
