(1.) Sarup Chand filed an application for ejectment of Shamsher Singh tenant from the house in dispute on the grounds of non-payment of rent and - personal necessity as he wanted to shift from village Chhapianwali to Mansa town, in view of the present set up. Since the arrears of rent along with interest and costs were paid on the first date of hearing, that ground did not survive. The Rent Controller found that the landlord had failed to prove the ground of personal necessity and accordingly dismissed the petition. The landlord filed an appeal before the Appellate Authority who believed his statement and came to the conclusion that the landlord wanted to shift from village life to town life and ordered the ejectment of the tenant. The tenant has come up in revision to this Court.
(2.) After going through the judgment of the Court below, I find that there is no merit in this revision. The Appellate Authority has believed the statement of the landlord and has recorded the following findings :-
