(1.) Gurcharan Singh and his two sons have filed this writ petition under Articles 226 and 227 of the Constitution of India for issuance of a writ of certiorari quashing the orders passed by the Commissioner and the Financial Commissioner, dismissing their application for ejectment of their tenant, Joginder Singh.
(2.) Petitioner's filed an application under Section 14-A(i) of the Punjab Security of Land Tenures Act (hereinafter called the 'Punjab Act') for the ejectment of their tenant Joginder Singh on the ground that he had failed to pay rent regularly and had not cultivated the land in the manner and to the extent customary in the locality. The tenant contested these claims. He pleaded that he had offered the rent to the landowners, but they refused to accept the same. He also contended that he had cultivated the land in the manner and to the extent customary in the locality. This application was rejected by the Assistant Collector on 2nd of January, 1975.
(3.) The petitioners filed an appeal against the aforesaid order. The Collector accepted this appeal and held that the respondent-tenant had failed to pay rent regularly without sufficient cause. He ordered the ejectment of the tenant from the land in dispute.
