(1.) At this stage, it may be noted that the allegations, against the petitioner, are serious. It is alleged that the petitioner had been registering false FIRs of the road accidents in order to help the dependents of persons who died due to cancer to claim compensation from the insurance company.
(2.) The petitioner by filing the writ petition, under Article 226/227 of the Constitution of India, has sought the following substantive reliefs:-
(3.) The respondents have filed a detailed written statement and the petitioner has also filed replication. At the outset, it is important to note that since criminal proceedings as well as departmental proceedings, are pending, it would not be appropriate to make any final observation which may prejudice the case of any of the party. The observations being made are limited to the decision of the writ petition, leaving it to the parties, to contest the proceedings before the authority/Court.
